Tens of police officers guarded the public toilet and escorted Chinese female prostitute away
At around 4pm, a middle-aged female with brown curly hair, green top and jeans, and heavy makeup appeared among the crowd, who was then surrounded by protesters on the spot. However, she seemed to be not frightened, and was still smiling and playing with her smartphone. Protesters gave her red-packets and shouted ‘Sing! Sing! Sing!’. The female was then escorted away with the aid of police officers to a public toilet inside Tuen Mun Park. Several officers guarded the entrance of the toilet, restricting access to the toilet.
These middle-aged women used to make a fortune by entertaining old men and receive red-packets from them. They were often seen to be allowing the old men to touch them inappropriately or making erotic poses in public, in a park that full of kids playing inside.
In Sin Kam Wah v HKSAR (2005) 8 HKCFAR 192, the Court of Final Appeal laid down five ingredients to the offence of misconduct in public office. It is committed where:
(1) A public official;
(2) In the course of or in relation to his public office;
(3) Willfully misconducts himself by act or omission; for example, by willfully neglecting or failing to perform his duty;
(4) Without reasonable excuse or justification; and
(5) Where such misconduct is serious, not trivial, having regard to the responsibilities of the office and the office-holder, the importance of the public objects which they serve and the nature and extent of the departure from those responsibilities.
