Teenager, arbitrarily arrested for assault on police officers on 31/10, was released and compensated legal fees after the withdrawal of prosecution
On the Halloween of 2019, Netizens called on the ‘Massacre Halloween’ at Lan Kwai Fong Central and ‘8.31 Mourning Event’ at the Prince Edward station. A 22-years-old male was charged for assaulting inspector X at Shanghai Street on that day, and the case was brought to trial again on the 10th of February, 2020 at West Kowloon Magistrates’ Court. The prosecution said after consulting legal advice, they decided to withdraw the prosecution, and the withdrawal was allowed by the court. The defendant was released on the spot and received the compensation for the legal fees. The male claimed that he would continue to participate in rallies with Letter of No Objection.
Principal Magistrate Mr. Law Tak-chuen approved the application of compensating the legal fees to the defence, involving damages of $30,000, without the objection from the prosecution. In case the actual amount could not be compromised, it would be determined by the District Court.
The defendant is a salesperson, who was accused of assault on police officers, claiming him to attack police inspector X outside 676 Shanghai Street, Mong Kok, on the 31st of October,2019. Leung was allowed to go bail after the previous trial, and his prosecution was withdrawn today.
